The Regional District of Okanagan-Similkameen (RDOS) is undertaking a review of its land use bylaws with the intent to regulate the creation of new privately owned and operated community water and sewer utility systems.

The Regional District welcomes input from all persons who believe that their interest in property is affected by the proposed Official Community Plan Amendment Bylaw No. 3045, 2024, Zoning Amendment Bylaw No. 3046, 2024, Subdivision Servicing Amendment Bylaw No. 2000.18, 2024, or Development Procedures Amendment Bylaw No. 2500.33, 2024.

To provide opportunity for early and ongoing consultation, the Regional District encourages all persons who believe that their interest is affected to provide input prior to first and second reading of the proposed bylaws, scheduled to occur in March 2024.

PURPOSE OF THE BYLAW(S):

The purpose of the proposed amendments is to prohibit the creation of new private community water and sewer systems. More

specifically:

Amendment Bylaw No. No. 3045, 2024, proposes to amend each of the Regional District’s Electoral Area Official Community Plan Bylaws by introducing new objectives and policies discouraging the creation of new private community water utilities, including those owned and operated by a strata corporation, utility or corporation.

Amendment Bylaw No. 3046, 2024, proposes to amend each of the Regional District’s Zoning Bylaws by introducing new definitions for “community water system” and “community sewer system” which include systems owned and operated by the Regional District, a municipality, an Indigenous governing body or an improvement district but exclude systems owned and operated by a strata corporation, private sewer utility or business corporation, and;

Proposes to amend the Okanagan Valley Zoning Bylaw No. 2800, 2022 by introducing minimum parcel size exceptions for subdivision requiring that where the Bylaw establishes a minimum parcel size of less than 1.0 ha for a new parcel to be created by subdivision, this minimum parcel size shall only apply to parcels connected to both community water and sewer systems.

Amendment Bylaw No. 2000.18, 2024, proposes to amend Subdivision Servicing Bylaw No. 2000, 2002, by replacing the definitions for “community water system” and “community sewer system” to include only systems owned and operated by the Regional District, a municipality, an Indigenous governing body or an improvement district, and to exclude systems owned and operated by a strata corporation, private sewer utility or business corporation.

Amendment Bylaw No. 2500.33, 2023, proposes to amend Schedule 4 (Application for a Development Variance Permit) under Development Procedures Bylaw No. 2500, 2011, by requiring proposals to vary the zoning bylaw’s definition of ‘community water system’ or ‘community sewer system’ to be accompanied by a ‘utility condition assessment’ report from a qualified professional engineer.

For further information about the content of Amendment Bylaw No. 3045, 2024, Amendment Bylaw No. 3046, 2024, Amendment Bylaw No. 2000.18, 2024, or Amendment Bylaw No. 2500.33, 2024 and the land affected by them, persons are encouraged to inspect a copy of the proposed Bylaws at the Regional District of Okanagan-Similkameen office at 101 Martin Street, Penticton, BC, on weekdays (excluding statutory holidays) between the hours of 8:30 a.m. to 4:30 p.m.
